Larceny in The Night Time

Crime:
In Oklahoma the punishment for the crime of larceny is enhanced when committed in the night time.

Punishment:
When it appears that such larceny was committed by stealing in the night time, from the person of another, the offender shall be guilty of a felony punishable by up to ten (10) years imprisonment in the State Penitentiary.

Chapter 68 - Larceny Section 1704 - Grand Larceny and Petit Larceny -

Definitions Grand larceny is larceny committed in either of the following cases:

1. When the property taken is of value exceeding Five Hundred Dollars ($500.00).

2. When such property, although not of value exceeding Five Hundred Dollars ($500.00), is taken from the person of another.

Larceny in other cases is petit larceny.

When it appears upon such trial, that such larceny was committed by stealing in the night time, from the person of another, the offender shall be guilty of a felony punishable by imprisonment in the State Penitentiary not exceeding ten (10) years.
