Crime:
In
Oklahoma the punishment for the crime of larceny is enhanced when
committed in the night time.
Punishment:
When
it appears that such larceny was committed by stealing in the night
time, from the person of another, the offender shall be guilty of a
felony punishable by up to ten
(10) years
imprisonment in the State Penitentiary.

Chapter 68 - Larceny Section 1704 - Grand Larceny and Petit Larceny -
Definitions Grand larceny is larceny committed in either of the
following cases:
1. When the property taken is of value exceeding Five Hundred Dollars
($500.00).
2. When such property, although not of value exceeding Five Hundred
Dollars ($500.00), is taken from the person of another.
Larceny in other cases is petit larceny.

Section 1708 - Larceny in Nighttime - Penalty
When it appears upon such trial, that such larceny was committed by
stealing in the night time, from the person of another, the offender
shall be guilty of a felony punishable by imprisonment in the State
Penitentiary not exceeding ten (10) years.
