All too often we’re faced with situations beyond our control. This includes a slip and fall accident while visiting someone else’s property. If you’ve been injured in a slip and fall accident on another’s property, you may be entitled to recover money damages for your injuries.
You’ve Slipped and Fell:
In Oklahoma the owner or occupant of a property has a duty to take reasonable care owed to those who come onto the property. The amount of care depends on why you were on the property. Whether by invitation, permission (Licensee), or even, to a certain extent a trespasser he owes you a duty of care. Of course the law imposes a different duty for each type of visitor to the property.
The duty that an owner or occupant of a property owes to someone who they have invited to their premises is to “use ordinary care. This care is to keep the premises in a reasonably safe condition for the use of his invitees”. Oklahoma Jury Instruction Chapter 11 § 11.10. Someone who is injured on the property of another must have been expressly or impliedly invited for some commercial or business purpose for this duty to apply. This is the duty that applies to a shop or other business owner. An example includes you falling in a retail store because the employees left water on the floor. If you slip and fall because of this water you’re entitled to personal injury money damages. Those damages include medical treatment and pain and suffering.
