Whenever
the death of a person results from an injury inflicted by the negligence
or wrongful conduct of another, damages may be recovered for the death
from the person who caused it, or whose agent or servant caused or
contributed to it. If the act was intentional, or done with gross
negligence, punitive damages, or those damages that are designed to
punish the wrongdoer may be recovered by the estate of the victim of the
wrongful death. The cash or cash equivalent amount that may be
recovered, less funeral expenses and the cost associated with the
administration of the estate together with all reasonable attorney fees
required to prosecute the wrongful death lawsuit shall be for the
benefit and be distributed to the relatives of the deceased. Each state
has its own formula for determining the distribution of any recovery for
the wrongful death. All of the States provide that the lawful spouse is
a designated beneficiary. See Lewis v. Allis Chambers Corp.,
615 F.2d 1129. Most States take the approach that if the deceased leaves
a child or children, and a Spouse, then the distribution will pass one
half to the widow or widower and the other half to the children. If the
victim of the wrongful death leaves no spouse or the spouse is also the
victim of wrongful death then the whole of the recovery passes to the
children as sole beneficiary's of the wrongful death victim. If the
victim of the wrongful death dies without a spouse or children then the
recovery will be passed to the mother and father of the deceased. When
the wrongful death is inflicted on a child most states provide that the
beneficiary is the Mother and Father, and in the case they are also
deceased, the Grandparents or Brothers and Sisters of the wrongful death
victim.
