New Credit Counseling Requirement for Bankruptcy The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 reformed the United States Bankruptcy Code and created additional requirements for debtors requesting bankruptcy protection. One of the most noticeable changes for filers is the requirement for completion of two specific credit counseling courses. A certificate of completion of credit counseling must be obtained prior to filing for bankruptcy and then a post-petition personal financial management instructional course must be completed prior to bankruptcy discharge. Each course must be completed with a provider approved by the Executive Office of U.S. Trustees.
