Oklahoma, legal separation is an exception to the rule that a husband and
wife cannot alter their legal relations (except as to property) by
contract. (Okla. Stat. tit. 43 § 205). Legal separations are
treated much like divorce in Oklahoma. Upon the filing of a
petition for legal separation, the court will make provision for custody
or guardianship of all minor children of the marriage as well as assure
that provision is made for medical care, child support, education and
visitation of the non-custodial parent. (Okla. Stat. tit. 43 §
112). It is the goal of the court to seek the best interest of the
child and, in doing so, the court will seek to assure that there is
frequent and continuing contact with both parents involved in a
separation as well as encourage cooperation from both parents if doing
so would be in the child's best interest.
In
a separation situation in Oklahoma, there is no preference as to which
parent should have custody. Rather, the court looks at factors
like which of the parents in a separation would be more likely to allow
the other parent to have frequent and continued contact with the child.
