Payments
to Family and Friends: Oklahoma
Chapter 7 Bankruptcy
What
if I make payments to pay back family and friends for debt that I have
with them?
Large
payments
to family or friends within a year of filing Chapter 7 bankruptcy is an
improper transfer. Family and friends are considered
"Insiders". You can't make payments to them at the expense of
the rest of your creditors. Even though they may be legitimate
creditors, they should be listed as such but any payment to them is
presumed to be fraudulent. If they have a legitimate claim in the bankruptcy
let them comply with the bankruptcy requirements and get in line with
the rest of your creditors.
