What
happens after the bankruptcy petition is filed?
The
first thing that happens is that the automatic stay takes effect. Under
the automatic stay it will be a violation of federal law for a creditor
to continue to try to collect from you. All law suits, garnishments,
collection letters, phone calls or any other attempts to pursue remedies
should stop. If they continue they could face sanctions from the
bankruptcy court. All attempts to collect will have to first go through
the bankruptcy court. The creditor will have to petition the court
for permission to continue collection efforts. Typically this happens
only with secured debt for which your payments have become delinquent.
The creditor for such a debt can ask the court's permission to continue
the process to repossess the property secured by the debt. The court
will most likely grant the request if you have stopped paying.
